Solo Kiwi Ventures Limited – Terms of Trade
By ordering a booking for a tour you agree to these terms to the exclusion of any other terms.
All orders for a tour booking are subject to acceptance by us at our sole discretion.
Once we accept your offer and confirm your booking then a contract will be made between us on the terms in this document and those in the advertisement for the tour booking. In the event of any inconsistency between these terms and the tour advertisement then these terms will prevail.
Once a contract is formed we will make arrangements for your participation in the tour so you cannot cancel the contract for any reason. In the event of your cancelling, cancellation fees will apply. All cancellations by you must be made to Solo Kiwi Ventures Ltd in writing: info@solokiwiventures.com
You must pay the required price for the tour in full at the time of ordering a tour booking or if permitted in the tour advertisement and pay an NZD500 deposit (terms as shown in the individual trip) at the time of order to secure your booking and the balance is payable no later than 40 days prior to travel
Deposits are non-refundable but may be used as credit for any future tour/retreat.
If you use the payment plan option available, an NZD500 (non-refundable) deposit is required to secure your booking. In the event of you defaulting by the final payment date, the deposit will be forfeited by you.
For cancellations by you up to 3 calendar months prior to the commencement of the trip, there are cancellation fees. We will retain the deposit and 20% of the amount you have paid. For cancellations between 2-3 calendar months prior to departure, we will retain your deposit and 50% of the amount you have paid. For cancellations one month prior to departure we will retain 100% paid by you.
UPDATED COVID POLICY FEBRUARY 2022
In the event that a tour or retreat is postponed due to a COVID event and you have paid in full, the balance of the retreat/tour will be refunded to you and your deposit held in credit with Solo Kiwi Ventures to be used to book the next available date or for any other Solo Kiwi Ventures tour/retreat of your choice. If you have paid a deposit only, this will be held in credit by Solo Kiwi Ventures to be used to book the next available date or for any other Solo Kiwi Ventures tour/retreat of your choice.
Please note that you are responsible for any of our destination’s vaccine/entry policies and your own countries upon returning.
We may cancel a trip at any time up to one calendar month prior to travel. We require a minimum of four bookings to proceed with a trip. In the event that we do this, you have the option of transferring payments made by you to a future tour/retreat or receiving a full refund subject to any unrecoverable costs.
We may cancel a trip any time up to departure due to external events beyond our control, ie) terrorism, natural disasters etc. In the event that we do this, you will receive a 100% credit to be used on any future tour/retreat.
Travel insurance is compulsory on all international trips. In the current COVID situation, it is imperative that you check your insurance policy for coverage and exclusions, including flights.
All payments are to be in NZD including bank charges. Credit card payments may include a 4% surcharge
The tours are targeted toward female travellers over 40
The advertisement/itinerary for the tour sets out what is and is not included. Usually, the price will include:
All accommodation
Airport transfers if arriving and departing on tour dates.
Breakfast each day.
One dinner
Other inclusions as listed on the itinerary
The price will not include anything that is not listed above. For example:
Flights
Lunch/Dinner.
Local Transportation.
Entrance fees to classes/workshops/attractions other than what is listed in the itinerary
Local taxes and gratuities for drivers/guides.
Travel insurance.
Personal expenses.
Any required visas.
Due to the unavailability of suppliers or other unforeseen circumstances we may need to change accommodation, transfers and other aspects of the items included in the price from those advertised and substitute it for a similar item. No refunds or compensation will be provided in the event that items are substituted as there should be minimal impact on the tour.
We reserve the right to cancel this contract if the minimum number of persons required for the tour is not reached by one month prior to the departure of the trip. In the event of such cancellation, all money paid by you will be refunded.
We expect you to act in an orderly and acceptable manner and not disrupt the enjoyment of others. We will not tolerate anti-social, aggressive or abusive behaviour, and culturally insensitive behaviour or behaviour likely to cause distress or discomfort to others on the tour. If we consider that you have breached this requirement then we may cancel the rest of your tour and no refund will be provided and we accept no liability for any consequences of the cancellation.
You must have a valid passport for international travel and be medically and physically fit for travel.
You must follow our instructions and procedures at all times.
You consent to receive any medical treatment which may be deemed necessary by us for your well-being in the case of accident, injury or illness during the course of the tour and you also agree to indemnify us in respect of such medical treatment.
Third-party providers:
All items included in the price are booked with and provided by third parties;
We may suggest extra activities operated by third parties for you to do during your tour at your additional cost. These activities are optional and you must make your own decision whether or not to undertake any activity.
We are not responsible for any goods or services provided by a third party and exclude liability for all such matters. We will provide reasonable assistance to attempt to resolve any issue with a third party.
Many of our activities are in or based around water, eg) snorkelling etc. You must ensure you are physically able to undertake any watersports and you waive any right to take action against us or any of our officers, employees or agents for any injury or damage suffered.
The decision to undertake any yoga activities is your decision. You must ensure you are physically able to undertake any yoga and you waive any right to take action against us or any of our officers, employees or agents for any injury or damage suffered.
To the fullest extent legally permissible, we are not liable for:
your safety or the safety of your belongings and you must take full responsibility for such matters;
any interruptions to the tour caused by events beyond our control such as strikes, weather or natural disasters;
any loss not reasonably foreseeable and any consequential or indirect loss or special damage which in any way relates to or arises from or in relation to this agreement.
Our total liability and that of any of our officers, employees or agents arising from or in relation to this agreement will not exceed the amount paid by you.
You agree to indemnify us for any loss or damage suffered by us as a result of, or in connection with, any breach of these terms or any negligence or wilful default, by you.
We collect personal data about you for the purposes of booking the tour and the items included in the price. We may also use your personal information for marketing purposes and to inform you of future tours that may be of interest.
We reserve the right to use photographs or videos taken during tours for promotional purposes.
These terms do not limit your rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other applicable laws. To the extent these terms are inconsistent with any applicable law then these terms will be read down to ensure compliance with such laws.
If any of these terms is held to be invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions are not affected.
You may not transfer or assign any of your rights under these terms.
These terms may not be varied except by written agreement.
These terms bind your heirs, next of kin, executors, administrators and assigns.
The laws of New Zealand will apply to these terms and the parties agree to the jurisdiction of the New Zealand courts.
These terms are the terms that apply in the contract between you and Solo Kiwi Ventures Limited (“we” or “us “) for you to participate in tours arranged by us.
